Erik Jaffe, a partner of Schaerr l Jaffe, was a featured speaker on the Federalist Society's teleforum about the federalization of elections.

This panel discussed the roles played by federal, state, and local governments in elections as defined by the U.S. Constitution, whether and how those roles have evolved in recent decades, and whether and how those roles could change in certain circumstances, including the COVID-19 era.

Erik Jaffe acknowledged that only under extraordinary circumstances should the federal government get involved in the election system, but suggested having a minimum standard to guarantee access to voting.

"Why shouldn't the federal government put a minimal standard that says all states at least in a time of pandemic should accept a request for absentee ballots without further justification?" Jaffe said.
