Amicus Brief Filed in U.S. Court of Appeals for the Sixth Circuit

On February 2, attorneys from Schaerr | Jaffe filed an amicus brief for the Chamber of Commerce and the American Tort Reform Association in a class action appeal by Nissan in the Sixth Circuit. The brief discusses the importance of Daubert analysis at the class certification stage and the distinction between premature rulings on the merits and analysis of common proof (which necessarily touches on what must be proved).
