Schaerr Jaffe partners participate in commercial speech webforum with the Federalist Society

Schaerr-Jaffe founding partners Gene Schaerr and Erik Jaffe joined a Federalist Society panel examining emerging legal challenges to corporate speech and the implications for First Amendment protections.

The discussion explored growing efforts by state and local governments to regulate corporate expression through litigation, legislation, and administrative action. Topics included climate-change lawsuits that seek to impose liability for corporate speech and association, Hawaii’s Act 11 restricting corporate political expression, and state laws requiring businesses to convey government-prescribed messages.

Drawing on their extensive experience in constitutional litigation, Schaerr and Jaffe joined fellow panelists in examining whether these developments are consistent with the First Amendment and the fundamental principles of free expression.
